ZONING BOARD OF APPEALS
MINUTES
August 7, 2003

PUBLIC HEARINGS:

·       File #2003-09 – Hearing opened at 7:30 p.m. for application for a Special Exception under Section 13 of the Willington Zoning Regulations for property at 156 River Road.  (Map 15, Lot 27, R80 Zone) Owner:  Thomas Buccino; Applicant:  Yong Sheng Chao.
        Members present:  R. Maloney, R. Manaskie, R. Claus, N. Wilson seated for C. Csiki, and C. Deskus seated for D. Brown.  Also present: Thomas Buccino, Yong Sheng Chao.
        Mr. Chao explained that he would be the only employee in a computer based business and that at no time would the amount of people employed be more than three.
        Mr. Maloney asked that the following correspondence by put into the record:
1.      Janet McAllister, EHHD, dated 8/5/03 report concerning Millworks’ compliance to
CT Public Health Code.
2.      James Humphrey, dated 7/17/03 letter addressing issues stated in Mr. Hisey’s
letter of 7/10/03.
3. Susan Yorgensen, dated 8/4/03 memo regarding wetlands issues.
4. Mark Branse memo to Carlton Csiki, dated 12/13/01.
        Mr. Buccino reported that the parking plan speaks for itself, and that parking is not designated.  He has not had a need to use the parking available across the street but will do so when needed.
        Dr. Chao stated that he is allotted three spaces.
        Susan Dinallo, from the Hall Complex at148 River Rd, reported that two spaces in dispute between she and Mr. Buccino are not being considered for this application.  Mr. Buccino and Susan Dinallo are trying to work out the dispute.
        Mr. Buccino said that he will be losing a tenant, Martino Fine Books.  The company will be moving to 148 River Road in February when it’s lease is up at the Millworks.
        Mr. Maloney asked if anyone in the audience was in support of the application.
        Robert Hisey stated he had previously reported being in favor.
        Peter Latincsics stated that he was in favor of having Dr. Chao’s business in town.
        None present were opposed.
        Mr. Maloney distributed copies of memo from Atty. Branse to Chr. Csiki, dated 12/13/01.
        Mr. Maloney requested that Mr. Buccino reply to Susan Yorgensen’s letter of 6/6/03 outlining layout of building, businesses corresponding to layout, and number of employees in each business.  Mr. Buccino supplied the information requested.
        Hearing closed at 7:49.  
·       File #2003-14 – Hearing opened at 7:50 p.m. for application for an 11’ front line variance to construct a deck on property at 10 Jared Sparks Rd. (Map 23, Lot 25, Zone R80) Owner/Applicant:  Clyde & Jean Hall.
Members present:  Members present:  R. Maloney, R. Manaskie, R. Claus, N. Wilson seated for C. Csiki, and C. Deskus seated for D. Brown.  Mr. & Mrs. Hall were not present for hearing.
A site walk was held on August 5, 2003 at 8:10 p.m.  Present for site walk were R. Maloney, C. Deskus, R. Wilson.
A discussion was had by members at the site walk that the correct distance was 23’ not 11’ as noted in the application.
Mr. Maloney read into the record:
        Craig Baker and Sheryl Garcia, dated 8/7/03, letter in support of application.
        Darryl Peters, dated 7/28/03, letter in support of application.
N. Wilson explained hardship of existing older home having two front yards bordering Jared Sparks and Common Roads.  He found no problem with accepting hardship.

·       File #2003-15 – Hearing opened at 7:55 p.m. for application for a variance under Section 8.02 (lot coverage) to pave parking lot at Center School, 12 Old Farms Road (Map 23, Lot 46, Zone R80) Owner/Applicant: Town of Willington, Board of Education.
A site walk was held on 8/5/03 at 8:15 p.m.  Present for site walk were R. Maloney, C.
Deskus, R. Wilson.
Members present:  Members present:  R. Maloney, R. Manaskie, R. Claus, N. Wilson seated for C. Csiki, and C. Deskus seated for D. Brown.  Also present: John Patton, First Selectman, Town
of Willington and Karl Acimovic, engineer for Town of Willington.
        Mr. Maloney stated they were surprised at the condition of the parking lot in question when the members did their site walk.  It had been graded and the base coat had been laid.
        John Patton stated he did not know they needed to go to ZBA for approval and that when Mr. Gary Jones, the Assistant Zoning Agent, explained what was needed, the Board of Education complied and applied for the variance.  He also stated that the new public works supervisor went ahead and started the job.
        Parking was being increased from 42 spaces to 59 spaces, the traffic pattern would change, and there would now be room for snow removal.  They would continue the side walk to accommodate school buses dropping off and picking up students without causing traffic tie-ups.
        Karl Acimovic explained that the drainage would go where it always had, to the south of the parking lot.  Detention basin was being cleaned up to accommodate drainage water and it would go along stone wall at edge of ball field to another detention basin in woods.
        Mr. Maloney asked what was happening along the stone wall adjacent to ball field.
        John Patton explained that the Recreation Commission was expanding the ball field and cleaning up along the stone wall.  They were also putting up a fence.
        Mr. Maloney read the names of all abutters noticed.  None were present for hearing.
        No one present was for or against application.
        John Patton also stated that the Town would be doing plantings along side of school on small grassy area adjacent to parking lot.

·       File #2003-16 – Hearing opened at 8:11 p.m. for application for a 5’ front line variance to construct roof over porch at 238 Village Hill Road (Map 47, Lot 16, Zone R80) Owner/Applicant:  Denise & Ronald Gantick.
Members present:  Members present:  R. Maloney, R. Manaskie, R. Claus, N. Wilson seated for C. Csiki, and C. Deskus seated for D. Brown. Mr. & Mrs. Gantick also present for hearing.
A site walk was held on 8/5/03.  Present for site walk were R. Maloney, C. Deskus, R.
Wilson.
        Mr. Gantick explained that the house was built in 1868 and that they wanted to add a porch on the driveway side.  The porch would basically be a deck with a roof over it.  The hardship would be that the house is too close to the road.
        No one was present either for or against the application.

Deskus (Received 8/7/03, Site walk 9/9/03 at 7:15 p.m., Hearing 9/11/03, Decision by 11/13/03).
·       File #2003-18 – Application for a Special Exception under Section 13 of the Willington Zoning Regulations for property at 148 River Road. (Map 15, Lot 27, Zone C-NC) Owner:  Francis & Gina Kosowicz; Applicant:  Martino Fine Books (Received 8/7/03, Site walk 9/9/03 at 7:00 p.m., Hearing 9/11/03, Decision by 11/13/03).

OLD BUSINESS:

·       File #2003-09 – C. Deskus made a motion, seconded by R. Claus, to approve a Special Exception under Section 13 of the Willington Zoning Regulations for property at 156 River Road.  (Map 15, Lot 27, R80 Zone) Owner:  Thomas Buccino; Applicant:  Yong Sheng Chao.
Members present:  Same as above.  
Mr. Manaskie discussed Atty Branse’s letter of 12/13/01 concerning septic system and
said that it was still a concern and that the Board did not know what kind of soil was in the system.
        Mr. Deskus stated that with the tenants in the building now, including Dr. Chao, did not tax the system and that it was below the historic use. He also said that the letter from EHHD stated that it fits within the Public Health Code.  Also that parking was adequate for the tenants.
        It was also noted that no abutting neighbors who were noticed did not seem to have any concerns.
        Mr. Maloney said the Board was pleased with the cooperation by Mr. Buccino in providing information with the application.
        Mr. Maloney also made a friendly amendment that: “This approval refers to this application #2003-09 only, that there would be only 3 employees and that any other applications submitted for this property would be subject to review by the Health District.”
        Vote:  All in favor.
·       File #2003-14 – R. Manaskie made a motion, seconded by R. Claus, to approve a 23’ front line variance to construct a deck on property at 10 Jared Sparks Rd. (Map 23, Lot 25, Zone R80) Owner/Applicant:  Clyde & Jean Hall.
Members present:  Same as above.
Vote:  All in favor.
·       File #2003-15 – R. Manaskie made a motion, seconded by R. Claus, to approve a variance  under Section 8.02 (lot coverage) to pave the parking lot at Center School, 12 Old Farms Road (Map 23, Lot 46, Zone R80) Owner/Applicant: Town of Willington, Board of Education.

Added to motion was request that Town Engineer look at water disbursement for the
property and report back to the Board in six months.
        Mr. Maloney made the friendly amendment and Mr. Manaskie seconded.
        Vote:  All in favor.
·       File #2003-16 – N. Wilson made a motion, seconded by R. Manaskie, to approve a 5’ front line variance to construct roof over porch at 238 Village Hill Road (Map 47, Lot 16, Zone R80) Owner/Applicant:  Denise & Ronald Gantick.
